4:14pm - Attorney for Oakmont Development is making his closing argument. He’s claiming that everything was open and transparent. He says that the property is zoned A3 and can be developed into a subdivision if they want. He claims none of the speakers against the project today have actually been on the land. Immediately after that comment there were rumblings of people saying “that’s not true”. He then claims that no speaker spoke on the technical merits of the development and once again people said “that’s not true” with others yelling “objection”.
He claims this development does not violate the minor plat ordinance. “It’s not an intrusive or large scale development” - snickers in the audience after that comment. “You don’t need to be an engineer to understand a 2″ main can’t handle 600 homes”.
4:23pm - Commissioner Bill Brown corrects attorney Niezer saying they are being asked to approve five minor plats and not just one as the attorney said. Brown asks what the capacity of the main will be that’s going in is it 600 like was suggested or just a handful as the attorney said? Ted Nitza is called forward and says that “there could be more than 28 homes added to the 2 inch line but it’s not in the hundreds”.
4:31pm - Bill Brown challenges the idea that they could move forward as is without this being a minor plat. Paul Moss states he wants an answer to that question. The planning department says the project could not go forward as is if it wasn’t a minor plat - there would have to be some changes in the layout. However, there would be no public hearing if that route were taken.
4:36pm - I hate to break it to all those following but this is going to pass.
4:38pm - The commission attorney explains the options to the committee. They can unanimously approve the development, unanimously approve subject to certain minor changes that must be met, or they can unanimously say it doesn’t meet the ordinance. If there’s a split vote then the matter would be turned over to the full plan commission and not just the executive committee.
I think the only chance for the anti-Canyon Cliffs crowd is for Commissioner Brown vote against the development and in that case it will go to the full plan commission.
4:43pm - Attorney says that if there was only 1 plat of 6 homes present there would be just as many people against it. Commissioner Brown and several other citizens disagreed.
4:46pm - Al Frisinger starts his final comments. He says his office is on top of the water quality issue and that they have an ordinance to monitor that so citizens don’t have to worry. Says this is a property rights issue and if the development is within the bounds of the law then it can be approved.
4:49pm - Ken Neumeister asks the commission attorney if the minor plat ordinance allows the stacking of plats like they are discussing? The attorney didn’t really give an answer - he says that’s the issue before the commission.
4:52pm - Neumeister asks for a staff recommendation. The staff says they are recommending approval.
4:56pm - Discussions with the lawyer about possible actions now taking place.
5:05pm - Committee delays the vote one week until next thursday at 10am.
On a personal note, I had a ton of work I needed to do today so now I’m going to be up half the damn night trying to get it done…

I agree with John B. Kalb.
Hold it. I thought the issue was the restrictive covenants. What happened to that discussion?

Paul Moss asked about that and was told that if the project was approved then the restrictive covenants discussion would go before the full planning commission. But this meeting was not to address that issue.
The time line that I had been given from Sunday evening’s meeting indicated that the issue for today’s meeting was the ACSWD action on the restrictive covenants.
It seems like that should have been the first step. Once the covenants have been lifted, then there really isn’t anything to stop this train from plowing through everything.
It won’t make any sense at all for the Plan Commission to approve the plat and then reinstate the restrictive covenants.
Are the covenants now gone for good?
The restrictive covenant is waiting to be discussed as of 5:32PM

Sorry, I confused the issue. There were two meetings scheduled for today. The first was the public hearing and vote on the approval of the minor plat ordinance. The second was on the restrictive covenants.
The full plan commission meeting on the restrictive covenants is now starting. It was originally scheduled for 1pm but it was delayed due to the executive committee meeting.
