Independent Candidate for Governor Christopher R. Stried was notified of his denial to appear on the ballot on August 19th, 2008. He then filed his rightful appeal to have a hearing on August 20th, 2008 on time before the deadline on August 22nd, 2008. The Indiana Election Commission however missed their own deadline of when they were suppose to conduct a hearing on September 5th, 2008. Politics is clearly involved in the matter as the Chairman of the Indiana Election Commission Thomas Wheeler was appointed by the current Governor Mitch Daniels, and the other 3 members consist of another Republican, and two Democrats. No Independent is involved. In between the time in which the hearing was to take place, there was no notification from the Indiana Election Commission, not even a scheduling of a date. Apparently, the members of the Indiana Election Commission do not have to do their jobs, all they have to do is let the deadline pass.
 
I am sure the news media is familiar with the Presidential Republican Primary in Indiana when John McCain did not have enough signatures to be on the ballot, he then appealed to meet before the Indiana Election Commission, and then they proceeded to put him on the ballot. When someone is denied to be on the ballot, they have a right to file an appeal and to have a hearing on the matter.
 
On Friday, September 12th 2008 Independent Candidate Christopher Stried will file a lawsuit against the Indiana Election Commission for failure to follow IC 3-8-6-12(i) under Indiana Law.
